I havent got my refund

We got their quote of $825 to ship our chevrolet malibu 2002 from Ithaca, NY to Lubbock,TX. we paid them a deposit of $125 on november 24 of 2010 via our credit card, we had to do this for them to send us an order form. They did send send us an order form via email saying that "The attached file contains your order form for shipping your 2002 Chevrolet MALIBU from Ithaca, NY to Lubbock, TX. To avoid delays with your shipment, please sign line 4 and line 7 and fax the completed order form back to us if we do not receive this order form signed & faxed back or scanned and emailed back 813-902-6104 you have 24 hrs. to do so or it will delay shipment of automobile.'
It also says in the order form that if we cancel our order before a trucker is assigned we will get a full refund of our deposit. According to the conversation we had with them they assign a trucker only after we send them the signed order form which we DID NOT, instead we canceled our order with them as we found a cheaper deal. After we called them to cancel our order they sent us an email on December 16,2010 which says "We understand the importance of providing Auto Transport Service to you and deeply regret that you have canceled your order we will process your refund immediately please allow 1-3 days for the funds to show on your credit card statement". BUT, we never received the refund, when we called them back they told us that we had to cancel the order in written form so my husband send them an email on December 23rd 2010. We did not get a response for this email. We called them again and they said that a trucker was already assigned and we would not receive a refund. Now how can this happen? First thing is we had not send the signed order form for them to assign a trucker and secondly they didn't say that a trucker was assigned when we asked them to cancel the order in the first instance.
More to this, we did not yet receive our refund, now when we call the customer agent, he says he is not the one dealing with refund and we have to call some Mr John but to my greatest disappointment we cannot get hold of him no matter how many times we try, he is on answering machine and we don't receive response to the voice mails we have left.
If anyone is reading this please suggest what I should do as $125 means a lot to us as a student with a family.
