Falsified Bill of Lading to hide damage

Nick picked up a flawless classic mini in NC. Upon pick up the Bill of Lading was signed, and indicated no damage to the car, however the driver did not provide a copy at pick up, he took all the copies with him! Car arrived damaged in Phoenix (minor paint damage) and the bill of lading had the damaged marked. Interested how that got filled out some place between pick up and drop off. The driver and his wife were very friendly on the phone during transport, but as soon as this claim was mentioned they went CRAZY! I was left rude voice mails, and the innocent guy who dropped the car off was even harassed. These two are nothing but trouble, and now I have to have a quarter panel repainted on a classic car. My insurance company will ultimately get the money from their insurance, but they are going to make me go the full mile to get it taken care of. There are plenty of companies out there that follow the rules, and provide the documentation to protect both the client and shipper. But not these two, they used the bill of lading to protect themselves from damages. Go to another company, an honest one.

On october 4,2012, the yellow, 1973 mini cooper in question was picked up from waxhaw, north carolina. As the driver has been trained to do since the start of our business in 2007, he inspected the vehicle prior to loading it on the trailer. During the inspection the driver pointed out the existing paint chips and scratches on the vehicle that were located on left, right and top of vehicle. After pointing out damages and marking them down on the bill of lading (our original copy attached), also known as our legal contract, the driver had him sign the bill of lading in the section marked at origin, owner or authorized agent, in which he signed the contract. The driver gave the pink copy of the bill of lading to him, which the driver has done and required to do during every single pickup as part of his job duties. The driver loaded the vehicle onto the trailer without incident. On october 8, 2012, the yellow, 1973 mini cooper in question was delivered to the complainant in scottsdale, arizona. The driver proceeded to unload the vehicle and the vehicle was inspected. No new damages, other than the ones previously marked on the bill of lading during pickup, were mentioned. Complainant signed the bill of lading in the section marked at destination, owner or authoriuzed agent and paid the driver the amount owed of $850 in cash with no dispute or without reporting any new damages. Just below where he signed the bill of lading it clearly states: please inspect vehicles at time of delivery akd report any damges to our driver. Company will not honor damage claims made after delnery inspection! Also, just below that it reads: read your contract - read your contract! The driver then proceeded to give complainant the yellow copy of the bill of lading as the driver has done and required to do during ever single delivery as part of his job duties. The complainant got in his vehicle and drove away. He waited a couple hours, then proceeded to contact our driver and complained of damages and stated we need to paint his entire vehicle. The driver asked him why he didn't mention it during the delivery and why did he sign the contract and pay the $850 owed, which releases the vehicle to his possession. The complainant told the driver, "i don't know". He again, called the driver a short time later to say that he would accept the $850 he paid in cash as a payment toward a complete painting of his vehicle. The driver advised him to read the contract again that he signed. The driver called into the office to advise me of the complaint and i attempted to contact complainant right away and left him a message to return my call but he never returned my call. I also contacted the seller of the vehicle, who was also the person who signed during pickup, so that he may provide complainant with the at origin copy of the bill of lading but he also proceeded to give a false statement that he did not receive a copy. I advised him that on every pickup and delivery we provide a copy and also asked him how he released a vehicle that he sold without receiving a copy or receipt and he stated he was unsure as to why. The claims that complainant has mentioned are clearly false. He states that his used 1973 mini cooper was flawless, however he was not the person who released the car to the driver. The person who released the car was signed the bill of lading with the damages marked on the contract and received his copy. Complainant also falsely accused our driver of filling out the damages somewhere between pickup and delivery. If that were the case, why did he also sign the bill of lading and not report the new damages to the driver? Also, why did he pay the full amount owed of $850 without making a complaint or contacting our office during the transaction? Complainant waited until our driver left, leaving him thinking that this was another successful delivery and another satisfied customer. The complainant is attempting to tarnish my company's reputation so that he can have his used, 1973 mini cooper completely repainted and he must feel that if he complains to the right people we will feel threatened and have no alternative. This is the reason why we pay our vendor for the service of receiving a legal bill of lading so that we may provide our clients with a copy at both points of the transaction but also protect ourselves from false claims such as this. We have been in business for over 5 years now and have over 230 successful transactions. We have a 100% rating on central dispatch, which is the site where all of our business transactions go through. We have not received this 100% rating and continue to be successful because we are not honest as he is attempting to imply. We are honest and will continue to provide the best customer service to our valued clients.
