Fairway Auto Is not Professional

Like most of the other reviewers I received an email from Ben Davidson (Vice President) saying that he had a cancellation and that he could offer me a discount. I originally got a quote from fairway and decided not to go with them because of the price of $870 which was quoted, I was starting to work with two other trucking compainies when I got the email from ben offering a discount. So I called him he explained they had a cancellation and that the car could be picked up between today 6/4 and saturday and the guys would be headed to texas I had no issues with that. Dispatch put me in touch with the trucking company Johnston trucking out of SC they are very professional my driver Chris was awesome I would do business with him again as he was honest.

Johnathn sent me a contract on 6/4 that said pay $175 paypal and cod is $450, estimated total of $650. I had no issues with this, I replied agreed to the terms stating in the email based on the converstaion of my car being picked up on 6/4 arriving in el paso within 4-5 days. My car arrived today and I was given invoice to pay an additional $175 to get my car instead of the $450 that was in the contract. Contacted Johnathan and his attitude was not professional as it was when they were trying to get my business he started carrying on about the terms and did I read the contract yes in the contract it talks a boout the 1-4 days pickup date of $275, But when they suppose vice president tells me this is what I need to pay because of the cancellation I trusted the vice president oh by the way that Johnathan says no longer works at fairway.

To cover fairways but Johnathan quickly types up a new contract and sends to my email within 5 mins of getting off the phone with me so I called him back and explained this is not what we agreeded to this is not the contract that I have from the 4th of june he tells me he just wanted to send me the contract for IRS purpose instead of yelling and becoming as unprofessional as Johnathan was being with me I thanked him for the business I did with his company and got off the phone.

I am pasting my original contact because I have seen that Johnathan gets defensive and does that when he responds to these reviews, Johnathan I have saved you lots of work, I talked about the 1-4 days that in the contract as you mentioned and even paste the contract for you, as I said before Nice doing business with you Johnathan I would not tell anyone about your company, but if someone is looking for an honest company call Johnston Transport in SC they are great people.

1. Fairway Auto Transport Inc. [license # 557953] hereafter referred to as Fairway agrees to have vehicle(s) described on quotation picked up on or about the dates requested, but cannot guaranty any specific pickup or delivery dates. Fairway will transport vehicle(s) on designated reliable carriers to meet shipping requirements. Fairway or its carriers do not guarantee pickup or delivery dates THERE IS AN EXTRA CHARGE FOR GUARANTEED PICKUP DATES [ see below]. All quotations include taxes, insurance and fuel surcharges, except any special services requested by customer, which will be added at time of delivery and disclosed to the customer.

2. The shipping [CARRIER]agreement is subject to all terms and conditions of the carrier's bill of lading. Copies should be provided at delivery.

3. Carrier accepts responsibility of vehicle after preinspection and customer or appointed agent signs inspection form. Carrier responsibility ends when vehicle is unloaded and customer or appointed agent signs final inspection. At the time of pick up, Customer and Carrier will carefully inspect the vehicle for pre-existing damage by completing a vehicle inspection report. The Carrier and Customer will both acknowledge the condition of the vehicle by signing a copy of the bill of lading. After delivery, this process will be repeated with the Customer and Carrier that delivers the vehicle(s). Damage must be noted in the proper place on the bill of lading and signed by the driver and Customer, regardless of weather or time of day. Signing the bill of lading and inspection report without notation of any damage verifies that Customer has received vehicle(s) in satisfactory condition, and that Fairway, Carrier, and their agents are relieved of any further responsibility. Customer MUST check vehicle thoroughly at time of pick up and again at time of delivery.

4. Driver/carrier will drive vehicles on and off the transporter. They will pickup and deliver to requested areas ONLY if safe, unrestricted, and mutually agreeable. It is illegal for any vehicle transporter to be over the approved length or height according to DOT regulations. Low hanging wires and/or trees can damage vehicles and the transporter itself. If you or someone you designate is not available to release or pickup the vehicle(s), it can be driven to designated areas. Any additional charges imposed by the trucking company will be passed on to the customer and paid at time of delivery..

5. All vehicles to be delivered with a balance due must be paid by cash, postal money order, or certified funds only, payable to the trucking company. Deposits are accepted thru the use of Paypal only.

6. Primary insurance for your vehicle(s) is provided by the carrier assigned to your move. Full coverage insurance is provided by carrier[retail value of automobile] a copy of the carrier insurance certificate will be available to the customer after car is assigned to the carrier.
7. It is against DOT (Department of Transportation) Regulations to transport vehicles with any personal items inside the vehicle. The driver has to enter the State Inspection Stations at each state. They can inspect the vehicles at any time and give the Carrier a fine up to $10,000.00 and/or remove the personal items from the vehicle. Auto transportation companies have the authority to transport vehicles only. Also, personal items are not covered under cargo insurance. It only covers the vehicle against transport damage. The company as a courtesy allows the customer to place 100 pounds of personal items in vehicle at their own risk [confined to the trunk], subject to permission by trucking company.

8. Fairway, Carrier, or their agents shall not be responsible for any of the following:

a- Damage to undercarriage, exhaust system, suspension, wheel bearings, tie downs, brakes, alignment, tune ups, battery or charging system. (No inspection evaluation is performed at pickup location) therefore Fairway nor its Carriers accepts responsibility for them.

b-Damage not detected at pickup location due to weather, lighting, or vehicle too dirty to inspect.

c-Damage to car phones, video equipment, or any antennas under any condition. It is recommended that you remove them.
d-If you put personal items in the vehicle, you will be responsible for any fines incurred by the carrier, if weight is in excess of 100 pounds allowable [subject to permission of trucking company]. Insurance does not cover personal belongings against theft or damage of any kind, this should be covered by your homeowners insurance or apartment renters policy.

e- Damage caused by fluids or objects flying up from the road, or out of the sky. Glass damage caused by road debris.

f-Damage to cloth or vinyl convertible, T-Tops, boots, bras, caps, or decorative tops.

g-Damage caused by vandalism during transport.

h-Damage caused by leaking fluids, such as battery acid, motor oil, transmission fluid, brake fluid, power steering fluid, radiator coolant, or fallout resulting from acts of god.

i-Damage caused by failure of factory tie-downs or pull through frame tie-down holes.

j-Vehicles that have defective or insufficient brakes, parking brake or parking gear.

k-Fairway reserves the right to transport vehicles via another trucking firm.

l-Damages caused on a brokered load become the responsibility of the trucking company hauling the vehicles.

m-Vehicles that are INOPs (Inoperable) at pick up or become inoperable during transport will be subject to a $200.00 INOP fee, unless notified at inception and reflected in price.

Fairway will not be responsible for rental car reimbursement. It will be necessary for the customer to make transportation arrangements during pick up, transport, and delivery of vehicles.

Fairway will not be responsible for the following:

1-Mechanical malfunctions exhaust assembly, alignment, suspension or tuning of engine.
2-All delivery times are estimated and Fairway does not guarantee delivery on any particular schedule.
3-Damage of any type caused by and/or resulting from any type of weather conditions: (snow, ice, rain, winds, floods, tornadoes, hurricanes, sand storms, act of God, etc.)
4-Damage to convertible tops.
5-Fairway reserves the right to transport vehicles via a sub contractor.
6-Furthermore, the following Terms and Conditions shall apply:

7-If we are unable to secure a carrier for the quoted price, Fairway reserves the right to either refund the deposit in full or request an additional sum of money in order for the vehicle to get moved. It is our intention to receive a minimum of $125.00 - $150.00 commission on each and every move for our service above the cost for the trucker, in the event that the trucker has to be paid additional the total amount of the sale must include this commission [trucking cost plus commission].

8-Any and all actions or proceedings shall be tried and litigated exclusively in the State and Federal courts located in Crescent City, Florida. Any right to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this paragraph is hereby waived.
Furthermore, State and Federal courts located in Crescent City, Florida shall have in jurisdiction and venue over the undersigned for the purpose of litigating any dispute, controversy, or proceeding arising out of or related to any service provided by Fairway. Additionally, it is hereby stipulated and agreed that the law of the State of Florida shall govern over any dispute arising out of or related to any service provided by Fairway. Furthermore the undersigned agrees to accept service of process sufficient for personal jurisdiction by registered or certified mail, to the address set forth below or its registered principal place of business.

Additionally, the undersigned agrees and promises to pay any and all charges incurred for services provided and all costs incurred in the collection of same, including but not limited to reasonable attorney's fees.
9-Based on Customer's acceptance of this agreement, Fairway, and/or Carrier is authorized to operate and transport Customer's vehicle from point of origin to the destination specified in the bill of lading and to drive said vehicle either at origin, destination or between the points of loading/unloading and the points of pickup/delivery.
10-If Fairway is not informed at the time of booking that vehicle has been modified [lifted, oversized tires or racks or in excess of 66 inches,] there will be an additional fee of up to $200.00 added to the price.

11-If a vehicle is being picked up from an auto auction and the customer does not inform us that the car is an inoperable vehicle, the trucker can charge up to $200.00 additional upon delivery.

Whether this agreement was accepted online [verbally], or sent to Fairway by email or fax, Fairway and Customer agree that they have entered into a legal binding contract for service. If the Customer acknowledged this agreement online, by mail or by fax, it is considered accepted and binding by both Customer and Fairway whether or not an actual signature appears.

If you would prefer to fax this agreement, just print it out, sign it , and fax it to 321-574-4117 or you can accept it by replying by email that you agree with contract and terms and conditions and typing your name.

If order is cancelled within 24 hours after booking , the cancellation fee shall be $50.00, if truck has been assigned $150.00 of the deposit will be forfeited. Cancellation fees for overseas orders will be the full deposit given. All deposits will be refunded within 5-7 days of cancellation.

Traditionally we are able to pick up your vehicle within 5-7 business days from the first available date the vehicle is available for pick-up. We will work with you to meet your schedule as much as possible. We offer expedited pickup services at an additional charge, please ask sales person when inquiring. If a customer drops a car at a terminal, the cost will be charged in addition to the fee at time of delivery. We offer specific pickup dates at a charge of $200.00 additional. We have no control over weather conditions, mechanical failures, DOT regulations, road conditions, or other customers' schedules. this customer has posted the contract which clearly indicates what she signed and returned, which states the services that we provide, she neglected to inform us and therefore assumed the type of service as per the contract, which clearly spells it out. there is no reason for this review and Johnson trucking is my trucker and that who was hired to move her car.
