Damaged Car Brokers Beware

I'm a broker who unfortunately contracted UI Express to ship a new Jaguar from San Jose to Utah for one of our regular customers. Vladimir has a small box on his inspection sheet that says if the weather is bad that he cant do a proper inspection and when you sign this believe me you are signing away your rights. Its like saying that no inspection was done and therefore if the car arrives with damage you cannot prove that it didnt already exist because " it was raining" therefore no proper inspection was done. So a brand new 2010 jag comes off the showroom floor and its raining. The poor yard guys signs this with the disclaimer about the weather and the car arrives 24 hours later with over $3000 worth of damage. Actually it didnt arrive, it was dropped in the parking lot at about 9:30pm,which Vladimir was told NOT to do. When the dealership called me to tell me about the damage I thought they were over reacting. $3000?? Sure, so we said get a better estimate or we will pay to have the car shipped back to my customer and I'm sure we can get a better deal from our body shop. They said come get the car, so I paid to have the car shipped back to CA out of pocket. The damage was extensive, I have no idea what could have happened in such a short period of time but the car was a mess and they were right, it cost almost every penny of that to fix. When I contacted UI's insurance company they agreed that it sounded like the damage occured on the truck but because of the loop hole on the inspection sheet, the damage could have been existing. Technically no inspection was done so on paper we had no recourse. The insurance agent was very sorry and said that another similar case had just happened and he felt very sorry for us and wanted to believe us but had to go by the book. So since then I have lost one of my best clients and would like to warn any other broker out there from using UI Express.He was also verbally abusive to both customers when confronted about the damage. What a nightmare.
