Car was damaged, would not pay for repair

We had been dealing with this company for years and never had an issue. Unfortunately, the one time a car was received with damage, the company refused to pay for the repair and it was obvious that the driver caused the damage by poorly placing the tie down straps. We can not in good conscience recommend this company any longer.

Our clients are asked to go over the condition of the car carefully upon receipt and before signing off on a clear bill of lading, as once they have signed off as being in good condition there understandably is no further liability on the part of the carrier. The car was unloaded in the evening from the top deck, at which time he would have had a close look at the underside of the vehicle, which he did with the aid of onboard trailer lights and his personal flashlight. It is not probable but possible the the damage occurred during transport but after carefully reviewing the claim our insurance company advised us to deny the claim, because the damage was reported TWO days after delivery on a clear bill of lading and it was entirely possible that the damage was caused by the client after the receipt of the car. The client did not even contact us and we learned of the problem from the shipper. The client further did not follow any normal protocol of obtaining estimates and having our appraiser look at it. Instead, after the fact the client then proceeded to offer a large bill for what appeared to be minor damage. After 21 years of successful operations, I am sorry and regret to see this incident has occurred, but still have to follow the advise of our insurance professionals. Had the problem been reported at the time of delivery or even in a timely manner, and protocol been followed, we might have been able to handle this differently. Respectfully, George Davis Pres.
