Evergreen did not pay the carrier

Booked with Evergreen, they were the Broker. The job was bid on by HMS Transport. I paid evergreen $3300 through my american express card, 11/15/11. When HMS showed up with my truck I gave them $500 cash I suppose it was fuel money but at this point not really sure why. They told me if I wanted my truck to move I needed to throw $500 above the $3300 I already paid........so I did. Today 9/24/12 yes that is correct almost a year later I get a facebook message from HMS saying that I owe them $3300. Because Evergreen never paid them.

How can this happen......

My contract was with Evergreen, never with HMS. Evergreen was paid in full and I handed HMS $500 when the arrived.
