Breach in the Terms of Service

We were shipping with Estes for over a year. In the last 4 deliveries at the end of 2021 and start of 2022, service started to really deteriorate. It became so bad that the last delivery on mid-April had so much inventory damage we had to stop shipping with them for good. What made it more troubling is that we took all the precautions, discussed the prior delivery problems with our supplier and came up with countermeasures (like very visible notices around the pallet, corner guards etc.) to remind Estes to handle our merchandise with care so as to avoid damages. We even documented all the damages in prior deliveries just to communicate to Estes what was going on and that they be more careful. Yet in spite of all the precautions, extensive damage still occurred! In fact, right now we are spending a lot of time undoing the effects caused by that last delivery. The cause? Loading something heavy on top of our pallet was the cause of the damage to majority of our merchandise in that last delivery. A total breach of terms of service when we specified in the Bill of Lading that Estes should NOT load anything on top of our pallet. The damage was so blatant that it really even made us think that Estes was purposely trying to take us out of business! Adding insult to injury- Estes even had the nerve to suggest that our claim had no merit because we noted in the delivery receipt SUBJECT TO INSPECTION instead of the specific observations about the damage. This is because at the time of delivery, the damages were not so apparent under the cover of shrink wrap and only became obvious when we had to strip down the wrap and open the boxes. We should have kept the driver from leaving our premises and delayed him for an hour at least from doing his other deliveries. This notation was their argument for just partially compensating us for the damage. On hindsight, we should have not agreed to this partial settlement as we thought we could sell the damaged merchandise easily. We are still struggling to sell them months after. By the way, the sales rep that handled our account did provide a good and friendly service. Sadly this did not eventually translate to the service we expected. and friendly. Learn from our experience! Don't ship with Estes!
