| Stolen/Hostage Boat |
This company took on a load for us. They took a boat on trailer to be shipped in their enclosed trailer from SC to WA.
They did pick the boat up on/around the time that they said they would, (On Dec 7th 2006).
They claimed that it would take approximately 7-10 days to deliver the boat to WA.
As of today (1/11/07) they have not delivered the boat. They are claiming that it is COD because "they have the boat and say so".
They initially signed a contract that they would deliver the boat and then bill us for the payment of $3500 for transporting the boat. In the contract we have a disclaimer that states:
Due to the high number of late deliveries, we will take off 10% of the total to the transporter if vehicle(s) are delivered 24 hrs late. If 48 hours late, we will deduct 20%. If 72 hours late, we will deduct 30%. If more than 4 days late, we will deduct 50%.
Now, being over 3 weeks late, we would only pay them 50%. So instead of dealing with that because of the late times, they decided to make it a COD and try to get full payment.
They were late in getting it to WA because of a truck breakdown for over 2 weeks. We allow for breakdowns and weather delays, within reason.
They are holding the boat hostage until the customer pays them $3500 COD. Which is a breach of our contract with them. They have gotten their "lawyer" involved, and he is telling them to hold it hostage until the COD is paid.
We have tried many times to contact them. They never answer the phone, nor return any of our calls.
We are in the process of reporting the boat stolen and trying to get it delivered to the customer.
Fortunately, the customer is working with us as much as possible(at this point). This has to be handled through the "civil" means because it is not technically a theft at this point. They have not tried to resell it to get the money owed to them.
We have told them multiple times (through their lawyer) that if they just deliver the boat we will pay them the money owed. We are willing to even ignore the late fees to settle this. They are still refusing to deliver and holding the boat hostage.
I do not recommend using this company for obvious reasons.
