Contract states price $750.00. On internet it represents prices subject to change due to gas price changes. Signed contract for $750.00. Competitior called and stated car would not be shipped for $750.00. Called Allyson and she confirmed $750.00 and they would ship for that price, competitor was wrong.


On June 29, Frank called and had driver but now wanted $800.00. Told him contract was $750.00 and he replied price sujbect to change per internet. I told him price subject to change before contract and once signed the price is codified. Frank created an ambiguity in contract and was now attempting to use this ambiguity to extort another $50.00. Frank stated he woudld not ship car and confiscate by deposit. I declared his refusal a breach of contract.

Frank then charged my credit card $139.00 even though the contract states the deposit will be $100.00. Have now stopped credit card payment.

I am sure a jury would find this a classic bait and switch type of fraud.

Oh yeah, the internet represents: "satisfaction guaranteed".

Customer was clearly informed that the prices are subject to change by $50 because we use an average based pricing system. We had a carrier available which was offered to the customer however the customer insisted he wouldn't pay any thing more then the $750, although he had been informed that the price can fluctuate. He continued to insist that his background in law supported that he was correct. Shortly after he contacted us to see if we still had the carrier available at which point the carrier had already booked another spot which really made Mike upset. He then went on to explain that we "codified" his price in writing when we clearly have a contract signed by Mike that specifies otherwise. Mike's Amex card was charged a cancellation fee as per the agreement which American Express denied his dispute to stop payment. So apparently we didn't do any act of fraud. Perhaps Mike would like to speak to a jury and see how they feel.
