Beware - Inconsistent Practices - Charged credit card without my agreement, commitment, or knowledge or use of their services!

Prior to reading these facts, PLEASE DO NOT MAKE THE SAME MISTAKE I DID. Email me at drodrigues@ovhd.com and I will provide you credible information that will make you stay away from this company. Do not be fooled by the friendliness of the staff - in the end, it's about the money they feel is owed to them. Bottom Line - THEY WILL CHARGE YOU IF THEY HAVE YOUR CREDIT CARD INFO - even if they provide no service or value. Furthermore, the charging is not consistent - the first time I attempted to use Angel’s they didn't charge me which I appreciated, but the 2nd time they charged me without any agreement or commitment on my part, and I didn't know it until I received my credit card statement.

I've filed with the Better Business Bureau, Office of Attorney General, and I've spoken to law enforcement. I will post on other sites as well and continue to do so routinely until this dispute is settled.

To Summarize, Angel's Moving Auto charged my credit card $175 without my knowledge or consent by using the credit card information from a previous transaction that did not go through. This theft was committed on a second, separate order I placed from this company as evident by the refund in the first order, which was cancelled.

I did not sign an agreement for the 2nd transaction and I did not receive dates or commit to a scheduled pickup or delivery. I was not warned that if I decided not to use them before I even commit, I would be charged $175. I never received a receipt, or anything to know I was going to be charged. No contractual work was completed or agreed to, and Angel's did not provide any additional service outside of the normal scope of posting. I was not informed I would be charged $175 for searching and I was not charged the first time they searched for me until I agreed to schedule and book a driver. Also, other transport brokers do not charge to search - call any of them and see for yourself.

This is electronic theft and a crime was committed.

I figured it had to be an honest mistake, so I contacted Stephanie on 11/03. She did not understand why I was charged and said she would call me back later in the day. I never heard from her, so I called her on 11/06 at 0815, and she put me on hold. She came back and aggressively said she did work for me and was charging me $175. I told her no one gave me an appointment, provided dates or times, nor I did not sign or agree to anything for this episode. I did not provide her my credit card info and she used what was on file from the previous transaction. There is no specified rate for searching for a driver. No other company has attempted to charge me for searching. I did not provide her permission to withdraw funds for this second episode. I asked her if I understood her correctly, and she sounded frustrated and said “well, I found you a driver so I’m charging you. That’s what I do” and hung up on me.

I called her back on 4 lines and had them all on hold since they were playing games with me. Finally I used a different number and Brittney answered. She asked for my name and asked what this was about. I told her she knew and she said “okay” and put me on hold. She came back and said they are charging me and Stephanie and everyone else were “busy with other things.” I provided her a message summarizing this paragraph and asked to have them call me back in 2 hours. No response.

11/06/06: Called at 1104. I was asked to hold, but I told Britney someone was going to call me back in 2 hours. Britney told me Stephanie went home sick after she asked me my name, and Dina stepped out. I asked if Stephanie was the manager and she said yes. She then put me on hold. Ten minutes later she came back and kindly provided me a statement from Dina, and said not to expect Dina to call me since she does not deal with staff issues since the answer is consistent. She indicated I should take the next steps to dispute this.

It's amazing how nice Dina was, yet her inability to communicate with me to resolve the issue or at least state her position, as a professional representative of her company is an excellent display of this Company and how they operate. It is unfair they charged me and now will not talk to me. This is a common theme throughout the negative responses so beware – Dina and Stephanie will talk to you until there is a problem, and then they ignore you and hope you go away.

Angel’s committed a crime and stole $175 from me, and the company will not even talk to me as if I'm the bad guy. I have an MBA and I am very familiar with law and credit card practices. Companies such as Angel’s that perform unethically and unfairly must be stopped and we must prevent this from happening to other people who might not realize their rights.

Subject: Stay FAR AWAY from this company - Day 2 Entry

I posted my first entry yesterday. Dina (Angel's Moving Auto), you refuse to talk to me on the phone, but it's amazing how quick you will respond to a negative comment that is viewable to your potential customers - this is another display of your unprofessional conduct that started as soon as I contacted you with an issue. Thank you for your notes, which skip all the details from yesterday, but nevertheless display that you knowingly stole $175 from my credit card without my knowledge or consent.

The contract I signed was for Invoice #: 762944. It states the amount and my obligation to conduct business with Innovative Automotive. After your company attempted to postpone the delivery, I cancelled and you kindly refunded my $175.00, which I greatly appreciated.

I NEVER received nor signed another contract for the 2nd, separate time (almost 2 weeks later) I tried to do business with you. I never received a separate email from you regarding a different trucking company, with a different invoice, and I never agreed (nor did I say "sounds good" as your notes indicate) or committed to any trucking company, service dates, schedule, etc....I cancelled my search just like I did with other companies that DID NOT attempt to charge me, especially a high amount like $175 for posting a single request on a trucking board and making a phone call to me once.

If you had every intention of deliberately taking MY money from MY credit card information you had on file from a previous transaction, without my knowledge, consent, approval, or without knowingly disclosing your intent to me, you have committed wire fraud, theft, and unethically and unfairly conducted business in violation of State and Federal law.

Finally, it's truly disappointing to me that you are neither professional nor courteous enough to talk to me about it on the phone, which I find suspicious and it makes me wonder how many others you have fell victim to your illegal activities. I refuse to be a victim and you will continue to hear about this until justice is served.
