NOT FULFILLING CONTRACT AGREEMENT

ARVIN ASSURED ME THAT THE COMPANY WAS LICENSED BONDED, IN GOOD STANDING WITH THE BBB AND THAT THEIR DRIVERS ARE COURTEOUS AND PROFESSIONAL, AND THAT HE COULD FULFILL MY TRANSPORT NEEDS. TRANSPORT FROM FL TO CA IN AN ENCLOSED HAULER IN A TIMILEY MANNER. I PAID IN ADVANCE ON 12/15/2008. AS OF 01/06/09 THE CAR HAS NOT BEEN PICKED UP AS AGREED UPON. I AM UNSUREOF THE QUALITY OF THEIR DRIVERS AND THE HONESTY OF THE COMPANY AS A WHOLE. I WILL SEEK LEGAL ADVICE WHAT A FIASCO.

Mr. Dennis Beasley had scheduled the pick up of his Corvette to be on January 7th, When my driver went to pick up the vehicle on the 7th Mr. Beasley said that he wanted the vehicle to go in an enclosed trailer. We cancelled the pick up with the open trailer and sent out a enclosed trailer the following morning to pick up the vehicle. On average the enclosed carrier cost about $500 more than the open carriers but in this case we did not charge Mr. Dennis Beasley for the enclosed trailer. When the driver picked up the vehicle both Mr. Dennis Beasley and Mr.William Billie Vanhook did an inspection of the vehicle and marked all the damages on the bill of lading which we have a copy of. The bill of lading stated that there were damages on the front end of the vehicle. After the inspection was complete Mr. William Billie Vanhook signed the bill of lading stating that the information was correct. Upon delivery of the vehicle both my driver and Dennis Beasley did a complete inspection on the vehicle to insure that there were no damages other than the ones marked on the bill of lading upon pick up of the vehicle. After the inspection was completed Mr. Dennis Beasley signed the bill of lading. The bill of lading that Mr. Dennis Beasley signed stated... "The Costumer/Consignee hereby acknowledges and represents that he or she has received this vehicle in the same condition as it has previously been delivered to the transporter except as noted above, and hereby releases the broker and transporter from any claims for damage to the vehicle. Will not honor any claims made after delivery signature." by signing the bill of lading Mr. Dennis Beasley accepted that the vehicle was delivered in the same condition as when it was picked up.
