Scammed us for over $2000 and never shipped our truck

On June 11th, 2018 I spoke with Gerry from Auto Rail Forwarders (located in Halifax Nova Scotia) as we needed our truck shipped from Fort McMurray Alberta to Southern Ontario. He explained the process, that we will receive our vehicle within 7-10days. They would need our truck dropped off at the GM dealership in Fort McMurray and they would deliver to the GM dealership in Welland Ontario. He was very friendly on the phone and seemed like a great guy, Oh was I wrong. We arranged pick up in Fort McMurray on June 22nd 2018 which would mean I would receive my vehicle in Ontario no later than July 5th (being generous with the 7-10 days as there is a holiday within that time frame). I email transferred him over $2000.00 as he required payment upfront (as most shipping companies do) in order to confirm my booking. He sent me an invoice confirming it was 'paid in full'. The day before scheduled pick up I called the manager of the GM dealership to make him aware that we would be dropping the truck off as Auto Rail Forwarders would be picking up our truck the next day, I gave the dealership a copy of my invoice to ensure there was no confusion upon pick up. On July 3rd I emailed Gerry in regards to an update on when our vehicle would arrive as I have two small children and my husband was still working in Fort McMurray and I needed to make arrangements for someone to drive me and my children to our vehicle as it was bring dropped off in a different city. He told me there were some delays and he would advise. I emailed him again on July 5th as I did not hear back from him and got no response. On July 6th I received a phone call from the GM dealership in Fort McMurray asking us when our vehicle was going to be picked up as it was still sitting in their parking lot. What a shock, here I thought I would be receiving my truck any day and it hasn't even been picked up. I called Gerry numerous times and left voicemails and never got a call back. I emailed him as well. On July 7th he finally emailed me back and did apologize as he was on vacation and was unsure what had taken place and why our truck was never picked up. He explained that he had to wait until the office in Alberta opened to find out what was going on. Once I heard back he said a driver would pick up in Fort McMurray that day. The GM dealership closed at 6pm so we waited and waited for a call saying it was picked up. My husband (luckily was still in Fort McMurray or it would have been a lot worse) went to the GM dealership and waited until closing time and when no one showed up to ship our truck he got the keys from reception and left with our truck. I have been emailing Gerry regarding getting our money returned to us as we had to pay our for another company to ship our truck. He tells me week after week he will get our money sent back to us and still has not sent anything. He keeps delaying, its been 55 days we have waited for our money to be returned. One thing I will give Gerry is that he is smart, he knows the right people to scam. Smalls claim court is only in province, I have to travel to Nova Scotia and file the claim at the nearest courthouse to his business. I cannot file it here in Ontario. Do not use this company, after I was scammed by him I started researching more and I am not the first and I am sure won't be the last.
